Sorry, I cannot agree with you as to your definition of a "win".  Many times, a party in litigation settles for peanuts because he comes to realize he is going to get his rear end kicked.  In the only patent case I ever handled, the settlement offer from my opponent dropped from $10 million to $20 thousand within a space of less than a week because of new evidence that my co-counsel and I discovered.

I'm certainly not saying anything like the above has occurred in our case, but it simply incorrect to conclude that taking money in settlement necessarily equals a win.  As with SGE, I invite you to ask other experienced attorneys about this.

Nevertheless, I appreciate you making the effort to put a number to your definition.  I would also agree that the language of the 10Q is interesting in terms of the possibility of ongoing royalties, and I hope we see such occur.
