From a strictly legal perspective, I concur that a settlement by definition cannot be viewed as a win by either party. From a PTSC business perspective, however, I would think our side views the settlement as a "win" or they would not have agreed to it. The settlement frees up resources, saves legal fees, provides additional validation of the MMP (time to go after other big fish) and cash in the bank, etc. It seems to me SGE and other posters are thinking more in terms of business strategy and benefits, rather than pure legal "wins" vs. losses.
Regarding the settlement amount, in aggregate my personal business "win" threshold is a minimum of $150+ million. I personally believe we'll learn that a combination of up front and deferred payments are incorporated, for a total well in excess of this number.
