Is the 950 k judgement something thats binding on future licenses?
No, although other alleged infringers will undoubtedly use the low award in negotiations, just as our representatives will, to the contrary, point out many of the factors that are being discussed in this forum.
How long does and appeal take?
Probably about a year from the time any such appeal may be taken, but could be more.
Can the 950 judgement be overturned?
Yes, but IMO would be unlikely, just as it would be unlikely for the verdict of infringement to be overturend should HTC appeal. My recollection is that the standard on appeal would be that the jury engaged in "manifest error", which means "clearly wrong", i.e., that there is simply no evidence that supports the verdict. This is obviously a difficult standard to meet, as it should be. The function of the appellate court is not simply to substitute its own view of the evidence, but rather, to determine whether there is any evidence that reasonably supports the verdict.
