I'm in virtually 100% agreement with you, except it is difficult for me to understand how merely sealing or not sealing documents in these particular cases would be the deciding factor between a nuisance value settlement and an "early 2006" value settlement. In other words, I can't imagine documents so senstive as to warrant such a "night and day" difference in the outcome.

Having said this, is such a thing impossible? Certainly not. Do I know for sure it won't occur? Nope. It just seems unlikely to me based on my experience as a litigator, although I would love for it to happen.
