I agree with you; however, should the judge had accepted the motion we would have to kiss off any other lawsuit. It would preclude any and all lawsuits on the same subject. On the other hand, these motions are usually made to strech the billing time, to delay the process, to intimidate the opponent and to increase the cost of litigation to the other party.
