Hey Sunpoop! If my understanding is correct, we ended up settling with everyone in the Colorado case, so there is no chance to Appeal in THAT venue.

However, in the current venue, there are certainly grounds for an Appeal IMO. However, what I don't know is whether such Appeal to this singular ruling can occur NOW, or whether the Appeal process can't be initiated until after the current proceedings are complete.

In any case, this outcome is certainly a big surprise to me. I honestly didn't think it was possible that we'd get this outcome - my opinion based purely on the content of our response to the motion. Ignore the fact that the patents have been amended, etc., etc., etc.? Amazing....
