I think you mean Colorado proceedings (prior to Markman)...?

The only things there are, preliminary, are the claims construction by defendants and plaintiff.....the language they each considered. Then the Markman hearing, where the judge used neither the language of the defendants or the plaintiff, and installed her own language.

The judge is forming his consideration based on the preliminary proceedings only.

Something at the preliminary stage in Colorado is at issue.
