Just sticking my nose in here, but it seems to me the only claims "eligible" for rejection would the ones specified in the request(s) for re-exam and any added new claims presented in the re-exam process. Why would they reject claims that didn't really necessitate review and probably received little/no scrutiny? With this line of thinking, it would seem that a whittled-down version of the '336 still exists. However, it would also seem that the claims with red meat were the ones specified in the re-exam request.
