Also, it seems more expedient to go the distance from here rather than to opt for small settlements and begin round 3, in light of the recent developments.

Either get some decent settlement dollars now or see you in court counselor, leading to either a trial by jury or settlement on the courthouse steps....then file round 3.

I suspect they will structure round 3 differently.

And the question was asked, do they live with this Markman forever or do they get a new Markman date should they file in a different state ?
