Another thought on this:

If Samsung was one of only a handful of companies infringing our patents but the largest one, we would probably be going to a Markman hearing.

Remember, there are somewhere around 180 companies left to sue and when you add up the potential settlement $s we would be risking quite a bit. I'm comfortable with DM's approach up to this point. What matters most is WHAT's NEXT.
