The Kessler case isn't currently being tried in any court. Kessler itself is a case from 1907, more than a hundred years ago. Its resulting doctrine was resurrected in March of this year in what is commonly referred to as the "Brain Life LLC" case from the Federal Circuit. Just do a Google on either "Brain Life" or "Kessler" and you'll find lots of stuff.
