To my best recollection, TPL/PTSC have not to date filed a motion for summary judgment on the issue of infringement.

Conversely, also by recollection, at least one of the T3 did file a motion for summary judgment of non-infringement. Should TPL/PTSC prevail on that motion, it would not establish that infringement has in fact occurred --- rather, the denial of the motion would simply mean that the mover has not established noninfringement. In other words, the denial of a motion for summary judgment does not establish that the opposing party's position is correct.
