3. SMAN, I thought of you when Mr. Handel brought up a case on point that seemed to mirror our case. He had just discovered this case so it was not included in his material previously submitted to the judge.

sunpoop, based on your post, it's very possible this new case was the GBT vs Apple case in Texas where Apple tried collateral estoppel against GBT and LOST. I sent the case reference to Mr. Handal yesterday who thanked me and said he would look at the case.
