It appears from what others have said that it really up to the judge when she decides on an issue. The question then is, is there any way to get her to address the issue. W are closing in what appears to be the maximum time from other cases that went to a Markman.

I'm sure she is not alone in making the decision she has clerks that assist her. They check the details and report to her their findings. She then makes her decision. I think thats the way it goes.

What other recourse does EDIG have if a decision is delayed unnessesarly .

From what Has been stated she is also handling other cases at the same time.
