Ron - general question please... Would this case be considered one in which the patent expiration set for 2015 is not in play because the charge of infringement is already on the books? That is if they are not intending on broadening their reach with Nintendo?

Then let's consider HTC where we went after a specific device/product. If we wanted to broaden our scope with HTC, are we up against the 2015 deadline?
