You better hope the BoD has the "qualifications and experience", "under the circumstances" to develope a contingency plan in the event they are locked up in litigation with TPL the next three years.

Based on history for the last four years, the only known fact about the BOD is that they will take care of themselves. The company could file for bankruptcy, but the BOD will make sure that they are fully compensated before the filing.
