Did you ever wonder how the negotiations went between Swartz's entities and PTSC on these dividend for warrant holders deals? Considering CJ was/is Swartz's EMPLOYEE and in-house counsel, and he was/is also PTSC's "main" BOD member (at least by compensation levels and committee membership), and CEO David Pohl has additional "business" ties to Swartz (which he still maintains), which "hat" do you think CJ was wearing when these deals were struck? Did he negotiate on behalf of Swartz and then counter negotiate on behalf of PTSC? Did he sit across from a mirror and have the conversation there?
Certainly, when you say Swartz held all the cards, you're probably not far off the mark, lol.
It would certainly be interesting to know how such negotiations where structured and through whom they were negotiated. In all this discussion about investigations, I hope if one takes place, it includes such interesting arrangements.
