The impression I got was that they were aware of the situation but until the examination team is ready to release it to the public, they will. Now it's only available for private viewing. I doubt there's anything illegal about it IMHO.

Maybe it's due to the fact that it's involved in the ongoing litigation and releasing the response to the public could harm the court case?
