I've only handled one patent case, but it wasn't for a public company. On the other hand, I have been involved in many cases in which public companies were involved as defendants, whether they were represented by me or some other attorney.

Frankly, I don't know the answer to your question, because once the confidentiality clause has been signed and the settlement completed, I don't have any further involvement with the case. However, and this is really outside my field, I would have difficulty understanding how any such clause could legally prevent a company from talking about anything other than the settlement terms --- a company must substantially comply with SEC guidelines.
