Are we definitely bound by yesterday's ruling or can we appeal it? I understand that it is still up to a panel to decide if an IPR is warranted, but that is 90 more days and may not go our way. I thought that Micron did not notify us within the one year allowed and now they supposedly sent the info to our former counsel and not to those currently working the case and that is deemed sufficient service? Plank, can we appeal this denial of our request? Also, it seems reasonable what emit said that the other 108 cases will ask for a stay to see if the IPR goes forward and we lose the momentum that began with the removal of 108 from the CE followed by consecutive positive claims construction rulings. Two steps forward and one step back.
