"Trying to tie 445 to 108 is not going to work."
Some of what they are trying to do in tying 108 to 445...is take the limiting rudimentary explanations of the 445 specifications, the details used to to teach the bare bones issues of the 445 patent and bring them over to the 108, there by limiting the 108 to those specifications.
It's like say, you invent the number system and you patent it. In your spefications you teach the rudimentary levels of various details patented, based on the numbers 1 through 12.
Such as.. various methods to use the numbers 1 + 1; 3 + 1; 4 - 3... or applications of ....+, -, *, /...etc.
In teaching the rudimentary levels you are limiting the full girth of your patented number system to teach the charastics only, having a balance of numbers 13 through infinity....where the broadest interpretation of your patented number syatem starts with number 1 through infinity.
What the defendants are trying to do is take the limited aspects of 445, or the rudimentary levels used to teach, and bring that limited teaching over to the 108 and place a limited value on the 108.
