Looks like Handal deicded to drive the 108, because we have the best opportunity to win on this patent. If we win on appeal the argument that 108 was not ruled on in CO, we are free to push forward, get a new Markman Hearing for the 108 and proceed to trial (or more likely, settlement). Handal must feel our best efforts against AAPL will be on fewer issues.

Am I missing something? What do you guys think? AAPL is going to want a stay until the appeal comes down.
