Let's just say DM and Apple have been cahoots for some time. Also let's say that Apple damn well knew they violated EDIG patents, pilfered out IP tech and that EDIG IP has helped drive billions in Apple profits and brand enhancements.
Let's say DM coozies up to EDIG with a contingency offer they can't refuse and then goes on to leads EDIG into the Texas law suits ( small settlements) and the Colorado Markman.
DM had some appeal reversal history with the Judge in Colorado ( which strangely surfaces) and then we are given some half baked fuzzy and incomplete Markman decision that we then have to wear around our neck like a "Scarlet A"
The CO. Markmans leads to the CE ruling and will for some time present significant legal barriers until a new Markman and better representation can prove our IP was stolen and that all EDIG stakeholders deserve significant awards and settlements.
From an Apple ( and/or a DM perspective) hopefully, EDIG simply runs out of resources before a jury trial.
A pretty skillful and brilliant strategy if you could get away with it.
