That's the key question. I don't know the answer, but will take a stab at it. With the re-exam and the amendments, we are essentially back to square one, a fresh start with a stronger, better-written and more enforceable patent. The previous Markman is obsolete (fortunately). We need to file a new round of lawsuits, and when a case goes to trial a new Markman will be required.

Please note: This is JMVHO. Maybe Sman or another with strong legal background can help out.

Whatever the case, I hope Fred and DM seize the momentum and keep the ball rolling.
