So the judge was clear, she favors the defendants. Questions:

1. If DM chooses to settle for a pittance (assuming defendants are agreeable) before the 30 days are up, does this mean the Markman "ruling" never officially takes place leaving them the option to move on to the next set of defendants and a new judge with a new markman?

2. Will DM choose to move forward, if so I'm assuming there would be a summary judgment for the defendants giving DM the opportunity to appeal?

Either way DM's next moves will give us an indication of their resolve and just how rocky our road may be moving forward. Any decisions one makes from here is perfectly understandable. Good for those who keep the faith, it ain't over yet IMO.
