It is a big miscalculation by defendants if this thing does go to Markman Hearing...

They may have considered EDIG a "Light weight" plaintiff, and they may think by presenting a unified front they will scare EDIG into sumission! However, as the case moves forward they will see that DM is not a "light weight", and if the case does go to Markman Hearing it shall cost the 16 plenty...

My view is that DM has nothing to loose and everything to gain by taking this thing to the Hearing. The only question is, is it the right time to do this just before the NEXT filing going after the High Hanging Fruit?

Either way there is a lot of negotiation going on right now, and no matter which way it breaks it is a "Positive" for EDIG...

IMO they are going to drag this one out to a point defense lawyers have billed enough before telling their clients about what it will cost them if the case goes to a Jury after a Markman Hearing Ruling that is positive for EDIG, and then they will open their wallets...
