Is this designation something that the company would have to apply for or is it an automatic upgrade based on recent filings? Is it really newsworthy if the designation could just as easily revert back next quarter?

Unable to call in due to work, but would be interested to know what, if any, anti-mothball protection we have now? And what exactly happens if a negative production decision is reached?
