As I've said many times before, nothing is impossible in litigation.  Especially due to the change in judicial attitude generated by the AIA, the likelihood is that the Federal Circuit will affirm.  However, as I also said when the second Grewal ruling was issued (the reversal, which is now on appeal), our case is novel in that we have the same lower court judge changing his mind on the same issue even though the facts and evidence also remained the same.  This may cause the Federal Circuit to use more scrutiny in its review, although the effect of the AIA remains an open question.

As always, we shall see.
