As I've said on countless occasions over the years, virutally anything is possible in litigation.  However, the likelihood here is that the appellate ruling will be "all or nothing".  The court will either agree with (affirm) Grewal or it won't   ---   if it affirms, then there is no infringement, but if it doesn't affirm, then the matter will head back to the district court and proceed toward trial.
