BaNos, remember that appeals in patent cases are taken only to the Federal Circuit. It is the only one with subject matter jurisdiction to hear patent appeals.

Also, I haven't been involved in a federal court appeal in many years so the procedure may have changed, but an appeal would usually be filed in the trial court, in this instance the NDoC. That's why I found it a bit strange that the NDoC's docket would show as closed/inactive/whatever, since the appeal delay has not expired. But again, that may just be how the system operates, and the cases might simply be "re-opened" if the appeal is filed --- after all, it's just a matter of punching buttons on a keyboard.
