They had their chance in February. They could, and should, have dug their heels in and refused to accept the Plan unless and until this critical information had been put into escrow by TPL/Leckrone(s)/Alliacense and verified by an independent thrid party against criteria provided by PTSC. They were all either dumb enough not to think of it or scared enough not to do it.

I wonder who will get the Preferred Shares when the BoD realizes they need to borrow money to pay themselves.
