No. Appellate courts cannot act on their own in that way --- they can only hear cases that are brought to them on appeal or by writ.

I'm sure the ITC ruling will be argued by our opponents in the HTC appeal, i.e., they will say that it is the correct interpretation and should thus be adopted instead of Judge Grewal's ruling. But the Federal Circuit will not be directly reviewing the ITC ruling unless an appeal is taken from that ruling itself.
