I believe Geoff is correct in what he has already posted on this subject. As you may recall, several of us thought TPL's appeal of various interlocutory rulings was unusual at this juncture --- this was why.

Just for further clarification, HTC has not taken any kind of appeal to date. The motion for judgment as a matter of law filed by HTC in the NDCA is, in essence, a request for reconsideration by the same court, not an appeal.
