We talk about which side will flinch first...respondents, claimaints, plaintiffs, defendants. How about which judge will make the first move. Judges in both venues are certainly aware of the goings on in the other cases. So who is going to make the first move? I believe at this stage it is not about which company will cave with the advancing pressure of court deadlines but which judge will step up to the plate and make his call. I know they are intellectual types and capable but I think once one has made his decision the other will copy. Why? I just think so. Soon we will know. GL
