JOINT MOTION TO CONDUCT THIRD SETTLEMENT CONFERENCE BETWEEN COMPLAINANTS AND GARMIN BY TELEPHONE
Pursuant to Order No. 15, Complainants Technology Properties Limited LLC and Phoenix Digital Solutions LLC ("Complainants") and Respondents Garmin Ltd., Garmin International, Inc. and Garmin USA, Inc. (the "Garmin Respondents"), jointly request permission to hold the third of their three settlement conferences by telephone. Personnel having authority to settle the case recently communicated by telephone and hereby seek permission for that discussion, which did not result in settlement, to satisfy the upcoming May 17, 2013, deadline for a third settlement conference. The Complainants and the Garmin Respondents have conducted in-person settlement conferences for the prior two settlement conferences and therefore this request is limited in nature. Accordingly, there is good cause to grant the request to permit the third settlement conference to be held by telephone. Complainants and the Garmin Respondents have conferred with the other Respondents and the Staff and they do not oppose this motion.
