an ITC Staff positive recommendation, revalidation at the USPTO, Acer playing games at the NDoC. Virtually no communication from the company. ITC Markman to be held next week where the ALJ could be awaiting the formal hearing to just adopt the Staff's recommendation relatively quickly. Given all of the prior Markmans and persuasive authority on this case along with the favorable Staff recommendation and USPTO reexams, the ALJ IMO eould be well within his right to offer up a Markman ruling quickly. All of these arguments have already been reviewed in the EDoT and NDoC and the USPTO. I would be willing to bet virtually no other patent has been examined this thoroughly ever!!! Think about that ... I also think the company's silence is a good sign for my own reasons. I am prepared to eat piles of crow. March will hopefully be a pivotal month.
