I hear you about parties who constantly seeking continuances or resetting of deadlines because they never seem to be prepared, thus invoking needless delay into the system. In this scenario, however, I agree with Paul that the present motion to modify the Markman exhibit deadline is of no moment.

The delay is only three days, and does not affect anything else, i.e., the remainder of the case remains on its current schedule. And the delay itself is not over anything substantive, but merely pertains to the inclusion of exhibits. In essence, the parties are saying that they can use the time to put together a better, and perhaps more streamlined, presentation.

You are certainly correct in general, my friend, but in this particular instance, it's just small stuff. No harm, no foul.
