Are you trying to play word games again? You know you're not very good at that.
Saying that the $320 million averages only nuisance value doesn't in any way say or imply that it has "always" generated such --- by definition, "average" connotes exactly the contrary. Similarly, it would be a disservice to say or imply that it "wasn't always the case" for the MMP to generate nuisance value without saying that truly significant figures were generated only in the beginning.
As to the ITC complaints, I don't yet know whether it's a trivial thing or not, which is why I said that I don't view the mere filiing as either favorable or unfavorable. I'll give you my opinion as to whether it was trivial or significant once we start seeing some licenses from those defendants, should such occur --- if such settlements continue to be nuisance value, I'll probably conclude that the filing of the these complaints was indeed trivial. Until then, I'll simply stick with the facts, which is that the mere filing, in and of itself, is neither positive or negative and neither favorable nor unfavorable.
