Moxa, thanks for your post. I don't read the other forum in your link, but I did go there on this occasion and I saw that the Staff's recommendation was apparently posted only in part. It would be helpful if someone could obtain the entire recommendation and post it here, so that we can see the full reasoning.

I might add that I've been hesitant as to posting on this subject because I haven't wanted to appear as if I can foretell the future in terms of legal rulings. However, if the current Staff recommendation is accepted by the ITC and the cases are allowed to proceed, I'll make a post as to the underlying concept unless such is explained in the ruling itself.
