Ken or Frank,

Could you tell me if the NDA is still in effect. I believe that the CEO (RG) announced that all revenue has been recieved from the Japanesse settlements. If that is the case then what would be the need for the NDA to still be in effect? Of course, other than misleading investors, and potential licensees. This is a very important issue

that needs to be addressed.

Mr. Goerner's comments were specifically targeted to address investor expectations regarding the financial attributes of the settlement and their reflection in the Company's reported operating results for the third fiscal quarter. Nevertheless, a contractual condition of the settlement was that the terms remain confidential, so no specific or additional information can be disclosed.

Seems to be that additional terms remain?
