This is NASDAQ there are many MM;s and at times teh MM;s have relationship and will call someone not on teh bid letting him know that the tehy are Bid or Offerred "AWAY" and gives teh MM not on the bid teh right to buy.

 

OS even though your house might be "ON the Bid" teh sellers still sell to their favorite MM

and you don;t get the shares. 

 

P.s. I'm also trying to scoop some on the cheap but the bid has moved up on me,
