My understanding is that it is not a "cold call" when they legitimately have your information and have some business dealing with you. Whether or not they legitimately have your info if CMM gave it to them is another matter, although I suspect it would be.

Laws on recording phone calls in Canada vary by province. One souce I found says that one party consent recording is okay for personal or journalistic reasons, but NOT for business or commercial purposes.
