I like your analysis, docman, but I would like to add one little bit of my own supposition. This is purely my interpretation, with no supporting evidence, but I think that the CMM share movements recently reported to SEDI, under code 97 (Other) were Finskiy and Scola moving their shares into some arms-length trust or whatever, so that those shares can still be voted. I don't for a moment think that those shares will be voted in any way other than a way friendly to Scola/Finskiy's interests, but I also don't think those shares will be abstaining through an apparent conflict of interest.
