Johnny... read the last paragraph in Section 8.3 again...

"If Teck Cominco elects to proceed under 8.3(c) [75% back-in] it may, if in its sole opinion it deems warranted, make a decision to place the Propety into commercial production by constructing a mine and related infrastructure."
