I got a few emails last night thanking me for my post at 11:26, and one of them made a comment that caused me to go back and look at it. When I did, I found that I had somehow deleted the closing paragraph --- apologies for my bad editing.

In any event, I wanted to close by saying that, since I have no personal experience with Judge Fogel, I have no idea whether he will set a trial date at the upcoming CMC. He may do things differently than the judges in my venue, or it may be that, in his venue, very complex matters such as patent cases are seen as requiring more than one CMC. What I can say, however, is that the CMC is not a "settlement conference" as described in opty's post --- I'm sure the Judge will inquire about settlement possibilities, but that subject will not be the focus of the conference.
