I'm stating that in the event that TPL are not pursuing licensees, they would appear to be in breach of the Master Agreement. However, they might have a legitimate defense.

Without further details, it is impossible to determine either way, with any degree of accuracy, TPL's position.

In the event that the MA is voided, for whatever reason, what price is TPL going to exact for the reverse-engineered material?

It can never be a straight answer in law until determined by the courts.
