Might as well throw in the 749 as well.

There the examiner considered the 7/17/09 IDS of 54 pages submitted by the patent holder. Also went way back to the 3/31/08 IDS of 1 page submitted by the reexam requestor. I'm sure that we responded to the old request for reexam sufficiently and there would be no need to consider it again unless it was to defeat similar prior art in pending requests for reexam.

So here it looks to me like gearing up for a recert. Again, my theory my have holes, so don't do anything based soley on an untested theory.
