You may be absolutely correct in your thoughts but that does not mean they've admitted anything. They must feel this is their best defense "currently" however I'm sure they have several other issues to present if it becomes necessary.

If any of the issues are so weak (including the current one) that they feel they will not or may not succeed at trial, it just means they'll settle. After they've delayed things as long as possible of course.
