You are exactly right. So did the defense counsel...

In my post I stated the following:

"and she got them to agree that the two claims tried were DISPOSITIVE OF THE CASE..."...

I should have said:...

" That is why she concluded that the parties had agreed the two claims tried were dispostive of the case."...

Plankton is absolutelty right. Neither party agreed to the statement. They both wanted the 6 remaining claims RULED ON if she RULED against them on the first two claims tried...
