I'm sorry, I didn't mean to imply that the mining companies were blameless, nor to blame the First Nations. That's not at all what I meant. It's hard to bring the competing interests into alignment, so all can agree. I've been told that there are specific rights that can only be negotiated with one legal entity, but which are claimed by two. The mining companies can't settle the issue, as it is not in their power to settle that difference. It's a three-way problem, whereas the structure upon which agreements are to be based assume two parties only.
